His legal expertise was further demonstrated when he argued a case before the Supreme Court of the United States, Texaco Inc. v. Hasbrouck, which was decided in 1990.
In 1995, President Bill Clinton nominated Whaley to the United States District Court for the Eastern District of Washington. After being confirmed by the United States Senate, he served as chief judge of the District starting in 2005, eventually assuming senior status on July 12, 2009.
