Whaley's judicial career includes significant roles within the state and federal systems. He served as a judge on the Superior Court of Spokane County, Washington, from 1992 to 1995. In 1995, President Bill Clinton nominated Whaley to the United States District Court for the Eastern District of Washington. After being confirmed by the United States Senate, he served as chief judge of the District starting in 2005, eventually assuming senior status on July 12, 2009.
